Thanks for visiting www.cornwalllawsociety.org.uk (the “site“). This website is operated by The Cornwall Law Society of 2 Wendron Street, Helston, Cornwall, TR13 8PP (“we“, “us” or “our“). We are Cornwall’s independent local Law Society supporting 300 members in the county by providing guidance, CPD Training, marketing, recruitment and social events.

These terms (together with our Privacy Policy, Cookie Policy and other documents we refer to) set out how you may use the site whether as a guest or a registered member. Use of the site includes accessing, browsing, registering to use or posting on it.

Please read these terms carefully before using the site. By accessing and using it, you confirm that you accept these terms and agree to comply with them. If you do not agree to these terms, you must not use the site. If you use the site in breach of these terms, your right to use it ceases immediately.

We may revise these terms at any time by amending this page, so please check back regularly.

Our website

The site provides a resource for members of the Cornwall Law Society to connect with the Law Society and its members and stay in touch with activities, events and regulatory or legal updates. The site can also be used by members of the public to locate local and relevant legal advice.

Content is provided for general information only and is not intended to provide legal advice or professional recommendation on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the site.

Although we make reasonable efforts to update the information on the site, we make no representations, warranties or guarantees, whether express or implied, that the site, or any content on it, will be free from errors or omissions. We may update the site or its content from time to time. Please note though that content may be out of date at any given time, and we are under no obligation to update it.

You are responsible for making all arrangements necessary for you to have access to the site and for ensuring that anyone who accesses the site through your internet connection is aware of, and complies with, these terms.

We do not guarantee the site will be secure or free from bugs or viruses and you must not misuse the site by knowingly introducing material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the site, the server on which it is stored or any server, computer or database connected to it. By breaching this provision you would commit a criminal offence under the Computer Misuse Act 1990 and we will report any such breach to the relevant law enforcement authorities (and co-operate with them by disclosing your identity to them). In the event of such a breach, your right to use the site ceases immediately.

We do not guarantee that the site, or any content on it, will always be available or be uninterrupted. Access to it is permitted on a temporary basis and we may suspend, withdraw, discontinue or change all or any part of it without notice.

Intellectual property rights

We own, or license, all intellectual property rights in the site and the material published on it.  All such rights are reserved and you must not use any part of the content on the site for commercial purposes without obtaining a licence to do so from us or our licensors.

Equally, if you believe that any of your intellectual property rights have been infringed by the site, please let us know at info@cornwalllawsociety.org.uk.

You may print off one copy, and may download extracts, of page(s) from the site for your personal use (and you may draw the attention of others within your organisation to content posted on it). You must not modify the paper or digital copies of any materials you print off or download in any way, and you must not use any photographs, video or audio sequences or any graphics separately from any accompanying text. Our status as the authors of content on the site must always be acknowledged.

Limitation of our liability

Nothing in these terms excludes or limits our liability for:  (i) death or personal injury arising from our negligence; (ii) our fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be excluded or limited by English law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the site or any content on it, whether express or implied.

We will not be liable:

  • to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use, the site, or use of or reliance on any content displayed on it.
  • for loss of profits, sales, business, or revenue, business interruption, loss of anticipated savings, loss or corruption of data, loss of business opportunity, goodwill or reputation or any indirect or consequential loss or damage.
  • for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the site or to your downloading of any content on it, or on any website linked to it.

Where the site contains links to other websites and resources provided by third parties, these links are provided for your information only. We are not responsible for the content of websites linked to on the site, nor do we endorse them. If you choose to click on them, please be aware that they will probably have their own terms and conditions and privacy policies which you should make sure you read and are comfortable with. We will not be liable for any loss or damage that may arise from your use of these sites.

Membership area

Some parts of the site are restricted to registered members only.  You will need to provide some information when registering.  You will be provided with a username and password (you’ll be able to change the latter once you are logged in). This information will be held by us in accordance with our Privacy Policy. You must treat your username and password as confidential and must not disclose them to anyone else. If you know or suspect that anyone else knows any of this information, you must notify us immediately at info@cornwalllawsociety.org.uk.

Whenever you make use of a feature that allows you to upload or post content or comments to the site, or to make contact with other users of the site, your contributions and posts must:

  • be accurate, be genuinely held, and comply with applicable law in the UK.
  • not contain any material which, amongst other things, is defamatory of any person, is obscene, offensive, hateful or inflammatory, infringes copyright, database right or trade mark of any other person, is likely to harass, upset, embarrass, alarm or annoy any other person, promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, or is used to impersonate any person, or to misrepresent your identity or affiliation with any person.

You warrant that any contribution you make will comply with the above criteria. We reserve the right to remove any post you make on the site.

We can suspend or disable any username or password at any time if we know or suspect misuse or fraud or if, in our opinion, you have failed to comply with any of these terms.

Please note that the views expressed by members on the site do not represent our views or values.

Any content you upload to the site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, and display that content.

We reserve the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to the site violates their intellectual property rights, or of their right to privacy or if we are required to do so by law or any regulatory body. We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of the site.

Linking to our site

You may link to our home page and your individual profile, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to the site in any website that is not owned by you.

The site must not be framed on any other website, nor may you create a link to any part of the site other than the home page and your individual profile. We reserve the right to withdraw linking permission without notice.

Applicable law

These terms, their subject matter and their formation, are governed by English law (including any non-contractual disputes or claims). You and we both agree to that the courts of England and Wales will have exclusive jurisdiction.
